Man Is Sentenced To 10 Years IHL For Defiling Minor

Lilongwe Magistrate Court Monday sentenced Ali Mussa, 29, to 10 years Imprisonment with Hard Labour (IHL) for defiling a minor.

According to Lingadzi Police Spokesperson, Salome Zgambo, Mussa was found guilty and convicted for the offence of defilement which is Contrary to Section 138 (1) of the Penal Code.

“Three years ago, he was in-love with a business woman by the name of Loveness Kalimba. During their love affair, they agreed to perform some rituals on her children in order to make their business grow,” he told the Court.

Tchuwa said that Mussa performed the traditional rituals in the absence of the Kalimba.

After he had performed the same, he had carnal knowledge of a 12-year girl (name withheld) daughter to Kalimba.

In this case the victim had a cut on her private part hence pleaded with the Court for stiff punishment to deter would be offenders.

In mitigation, Mussa pleaded with the court for leniency because he has two children who depend on him.

He said he looks after his grandmother who is a cancer patient and told the Court that it was an agreement with his wife such that he was surprised seeing that he is the only one being convicted.

Senior Resident Magistrate, Florence Msekandiana conquered with the state that the act portrayed by Mussa was inhumane.

She said that cases of defilement are on the rise and such stiff punishment would deter other would be offenders.

Msekandiana sentenced Ali to 10 years IHL effective from the day of arrest.

Mussa, 29, hails from M’baluku Village in the area of Traditional Authority (TA) Chowe in Mangochi district.
